Copyright Notice: Software developed, owned, sold or distributed by iPrivacyTools.com and its owners (hereafter "software") is protected by copyright law and international treaties. Unauthorized duplication may result in severe criminal and civil penalties and will be prosecuted to the maximum extent of the law. Without additional purchase or license, software may be installed onto only one single computer, or onto two computers that are operated by one single user. You agree not to redistribute, sell, decompile, reverse engineer, disassemble, or otherwise reduce software to a human-readable form. All parts of software and software design are copyright protected.

The term "software" shall hereafter refer to both 1) software as described above, and 2) any and all other services provided by iPrivacyTools.com.

Agreement to Use Software Lawfully: You agree to use software in a responsible manner, limited to legitimate purposes only (such as increasing online privacy, testing of geo-targeted marketing campaigns, etc). Software is performing a simple function that is made possible by Microsoft in the Internet Explorer web browser, and by Mozilla in the Firefox browser. However, software, like any other tool, has the potential of being misused. You agree that your use of software will be in compliance with 1) all state and Federal laws applicable to the party operating iPrivacyTools.com (located in California, United States), 2) all laws of the country where the server you're using is located (indicated by the country you select with software), and 3) all laws in your jurisdiction. If you are unaware of all applicable laws or unsure of your responsibilities, you agree to ascertain that information or to consult with a qualified legal advisor (attorney) before proceeding with this purchase. While we firmly support Internet privacy rights, any use of software for illegal or malicious purposes is a violation of this agreement and our terms of use. Any user who commits any kind of criminal action through use of software surrenders any and all legal rights to privacy, protection, confidentiality, or anything else that a legitimate user of software could normally expect.

Prohibited Uses: Compliance with the preceding section includes (but is not limited to) NOT using the software to 1) send unsolicited or bulk email of any kind, 2) violate another website's terms of use, 3) commit fraud of any kind, 4) hack or attack another computer system, 5) break any copyright law, 6) access or distribute illegal material such as child pornography, 7) place bets or gamble, 8) harass, slander, defame, or libel any party, or to 9) engage in any other illegal or malicious activity.

Activity Logs: Logs of your Internet activity may be recorded, reviewed, and revealed for technical purposes and legal compliance, but will remain strictly confidential otherwise.

Usernames and Passwords: You agree to protect the secrecy of your account username and password, and understand that you are responsible for all activity that takes place on your account (any login using your username/password). Account sharing is not allowed.

Requests for Information: You understand and agree that we may disclose any and all information available including your true IP address, account history, and other identifying information to any law enforcement agency that requests such information via a subpoena or search warrant, without your consent or notification. We will also respond to civil subpoenas, but may first notify you if legally allowed to do so.

Limitation of Liability: The developers, owners, and distributors of this software are not liable for any violations by you, or losses incurred by you as a result of using the software. You agree to indemnify, defend and hold the owners of this software harmless from and against any and all claims, damages, losses, costs, attorneys' fees, or other expenses arising from, or in any way related to, your use of software.

Security/Privacy Precautions: Software is primarily designed to interact with the Internet Explorer and Firefox web browsers, and should not be relied upon for high level privacy without first deactivating external Internet applications and plugins (general instructions will be provided). Web browser cookies may also be used to track Internet activity, and it is your responsibility to manage/delete browser cookies before and after using software. You further agree to familiarize yourself with the security risks of using public proxy servers with our software, should you choose to do so. Finally, while our standard service fully supports secure web pages (ssl/https), it does not add extra encryption beyond that. Users requiring additional encryption may inquire about our deluxe service.

Software is Provided Without Warranty: While reasonable efforts are made to deliver high quality products, we do not guarantee software to be free from defects. The software is provided "as is", and you use the software at your own risk. We make no warranties as to performance, merchantability, fitness for a particular purpose, or any other warranties whether expressed or implied. Under no circumstances shall owners of software be liable for direct, indirect, special, incidental, or consequential damages resulting from the use, misuse, or inability to use software, including without limitation, lost revenues or lost profits, even if owner has been advised of the possibility of such damages. You are solely responsible for adequate protection and backup of the data and equipment used in connection with this software.

Prohibited Computer Applications: We do not allow the use of file sharing software, Internet spiders, bots, scanners, or any other automated processes that might jeopardize the stability of our servers or adversely impact the ability of other users to access their fair share of server resources.

Payments and Fees: Software purchase is a one time fee, and comes with 3 months of customer service and proxy setting updates. After 3 months, you may continue using the software with no additional charge by entering settings for public proxy servers yourself using the provided instructions. You agree to familiarize yourself with the security and legal risks of using public proxy servers before doing so. This section does not apply to our deluxe service.

Registration Review: Website owner reserves the right to review and confirm legitimacy of orders, which may cause delay with initial account setup. Such confirmation may require phone verification, or other identity confirmation. Therefore, "instant access" cannot always be guaranteed.

Feedback or Submissions: Unless specifically provided otherwise by owners, all feedback or submissions of any kind submitted to this Web site via contact form or email become the property of owners, to be used or not as owners choose, without cost or liability.

Severability: If any provision of this agreement shall be held to be invalid or unenforceable for any reason, it is, to that extent, deemed omitted and the remaining provisions shall continue to be valid and enforceable.

Applicable Law and Venue: The formation, construction, and interpretation of this agreement shall be controlled by the laws of the State of California, U.S.A, as such law applies to agreements between California residents entered into and to be performed within California. Any dispute relating to this agreement shall be subject to the exclusive jurisdiction of the state and federal courts in San Francisco County, State of California, U.S.A., and you agree to submit to the personal and exclusive jurisdiction and venue of these courts. You agree that your dispute will not be heard by a jury and may not be made part of a class action.
